In 2001, a printing factory in Baoshan District, Shanghai was registered and established. The land where the factory is located is rented by the local village collectively owned land for a lease term of 30 years.
Since 2015, the printing company owner Wang has suddenly become addicted to gambling, and has also pulled some “fox friends†who do not understand business and mismanagement into the printing factory and participate in the operation, which has gradually caused the business to be poor, until the deficit.
To make matters worse, in 2016, the printing factory did not pass the EIA, and the benefits became worse. From that year onwards, wages were arrears.
In the early days of wage arrears, the boss Wang promised to pay the salary at the end of 2016. Unexpectedly, by the end of 2016, the factory was completely shut down, and Wang also “running the roadâ€, leaving only a vacant factory, sporadic machinery and equipment and 23 workers who were in arrears.
Beginning in May 2018, everyone began to defend their rights through legal channels. Of the 23 workers, 17 were applying for labor arbitration, and 6 workers were prosecuted because they were retired workers and were not subject to arbitration.
The enterprise account has no penny, and the local village committee first pays the wages in full.
In the second half of 2018, labor arbitration and court decisions successively supported workers’ requests for printing plants to pay wage arrears. Because the printing factory refused to fulfill the obligation to pay the wages, the workers applied to the Baoshan court for enforcement.
According to the implementation, there is no money available for execution in the bank account and stock account of the printing company. The person in charge is also unknown. Only the printing factory has a dilapidated factory building and the remaining 12 years of land lease rights are available. Auction, liquidation and debt repayment.
However, the judicial auction usually takes a period of time, and the process takes a long time. If it is completed through the judicial auction, and then the auction payment is made to the workers, the whole process can be completed in the second half of 2019. This means that 23 workers will have to wait another full year to get their "hard-earned money."
According to the preliminary assessment, the printing plant and land lease rights are at least several million, and the proceeds from future auctions are sufficient to cash the wages. By actively communicating with the local government, Baoshan Court finally reached a solution with the village committee where the printing plant is located.
The special funds will be allocated by the village committee, and the wages of the workers will be paid in full. After the completion of the overall judicial auction work, the auction funds will be paid off to pay the wages of the workers. Shortly after the adoption of the plan, more than 800,000 wages were remitted to the escrow account of Baoshan Court.
